These Terms & Conditions apply to Rc Ball website use, event inquiries, bookings, payments, participation, and related services.
1. Agreement to These Terms
Rc Ball is operated by Pharmers Market LLC, doing business as Rc Ball. By using our website, submitting an inquiry, booking an event, making a payment, attending an event, or participating in gameplay, you agree to these Terms & Conditions.
If you are booking or participating on behalf of a minor, organization, school, business, venue, or group, you confirm that you have authority to act for that person or organization.
2. What Rc Ball Provides
Rc Ball provides mobile robot soccer entertainment for private events, school events, business events, community events, parties, and similar gatherings.
Services may include:
- Portable robot soccer arena
- Remote-controlled robots
- Game controllers
- Game balls
- Staff-operated setup and breakdown
- Gameplay instruction
- Match facilitation
- Basic event flow management
Exact services depend on the quote, booking confirmation, event location, event length, space, weather, staffing, and operational conditions.
3. Website Use
You may use Rc-Ball.com for lawful purposes only.
You may not:
- Submit false, misleading, or unauthorized information
- Attempt to damage, overload, scrape, hack, or interfere with the website
- Use the website to harass, threaten, spam, or impersonate another person
- Copy Rc Ball branding, photos, videos, designs, text, game formats, or business materials without permission
4. Event Inquiries
Submitting an inquiry form does not guarantee availability, pricing, or a confirmed booking.
A booking is confirmed only after Rc Ball accepts the event, confirms the event details, and receives any required deposit or payment.
5. Pricing and Quotes
Event pricing may depend on event length, location, travel distance, setup needs, staffing needs, parking, venue requirements, special requests, and schedule availability.
Quotes may include base event service, setup, gameplay operation, and breakdown. Taxes, travel fees, parking fees, venue fees, special setup fees, or extra time may be added when applicable.
Quotes may expire if not accepted within the time stated in the quote or booking communication.
6. Payments
Rc Ball may accept deposits, scheduled balances, full payments, and approved event payments through Square or PayPal.
Your event is not confirmed until the required deposit or full payment has been received.
The remaining balance is due 48 hours before the event unless Rc Ball approves a different payment schedule in writing.
Rc Ball may pause, cancel, reschedule, or decline service if required payment has not been completed before the event.
7. Deposits
Rc Ball may require a deposit to reserve an event date and time.
Unless stated otherwise in writing, deposits are non-refundable because Rc Ball reserves equipment, staff time, travel time, and event capacity for the scheduled event.
Rc Ball may apply a deposit toward a future event credit when a reschedule is approved.
8. Cancellations and Rescheduling
If you need to cancel or reschedule, contact Rc Ball as soon as possible.
Rc Ball may approve rescheduling based on availability, notice, weather, staffing, equipment, venue conditions, travel, and event circumstances.
Rc Ball may cancel, pause, modify, or reschedule an event due to unsafe conditions, weather, equipment issues, staff emergency, access problems, payment issues, venue restrictions, participant behavior, legal limits, permit issues, insurance concerns, or any condition that makes safe operation impractical.
If Rc Ball cancels before setup for reasons within Rc Ball’s control, Rc Ball may provide a refund, credit, or rescheduling option.
9. Weather and Outdoor Events
Indoor events are preferred. Covered outdoor events may be allowed when the surface, weather, lighting, crowd flow, and safety conditions are acceptable.
Rc Ball may stop or refuse outdoor gameplay due to rain, lightning, high wind, extreme heat, dust, wet ground, poor lighting, unsafe crowd movement, unstable surfaces, or other unsafe conditions.
The host is responsible for providing a safe, suitable event area unless Rc Ball agrees otherwise in writing.
10. Venue and Space Requirements
The host must provide:
- A flat, stable setup area
- Enough space for the arena, players, operator, and safe movement
- Reasonable access for loading and unloading
- Permission to use the event space
- Adequate lighting
- Safe crowd flow around the gameplay area
- Protection from unsafe weather when needed
- Parking or loading access when available
Rc Ball may refuse setup if the area is unsafe, too small, blocked, unstable, wet, heavily sloped, crowded, restricted, or likely to damage equipment.
11. Host Responsibility
The event host is responsible for:
- Getting venue approval
- Getting permits when needed
- Managing invited guests
- Ensuring minors have proper adult supervision
- Keeping non-participants away from equipment
- Communicating rules to guests
- Providing accurate event details
- Paying agreed fees
- Covering damage caused by misuse, reckless behavior, or ignored instructions
12. Participant Rules
Participants must follow all Rc Ball staff instructions and safety rules.
Rc Ball may deny or remove participants who:
- Act unsafely
- Ignore instructions
- Damage equipment
- Harass staff, guests, players, or event hosts
- Appear intoxicated or impaired
- Interfere with gameplay
- Enter restricted areas
- Touch equipment without permission
Removal for unsafe behavior does not create a refund right.
13. Waivers and Minors
Rc Ball may require participants, parents, legal guardians, event hosts, or organization representatives to complete waivers before gameplay.
Participants may be denied gameplay if the required waiver is not completed.
A parent or legal guardian must complete required waiver or consent forms for minors unless Rc Ball approves another authorized process in writing.
14. Equipment Use
Rc Ball owns or controls the event equipment unless stated otherwise in writing.
Guests may use controllers and participate in gameplay only under staff direction.
Guests may not repair, modify, move, open, disassemble, reprogram, charge, unplug, carry, or remove Rc Ball equipment without permission.
15. Equipment Damage
The host, responsible adult, participant, parent, or legal guardian may be charged for damage caused by misuse, reckless behavior, ignored instructions, unauthorized handling, or intentional conduct.
Examples include:
- Throwing, kicking, stepping on, opening, or removing equipment
- Food, drink, liquid, sand, rocks, debris, slime, glitter, or foreign objects entering the equipment or arena
- Unauthorized handling of robots, batteries, wiring, controllers, boards, tools, or chargers
- Allowing minors or guests to misuse equipment
- Ignoring Rc Ball staff instructions
Normal wear from ordinary gameplay is expected and is not treated as damage.
16. Safety and Operator Authority
Rc Ball staff may pause, modify, shorten, or stop gameplay at any time for safety, equipment protection, crowd control, weather, venue conditions, participant conduct, or staff judgment.
Rc Ball may change match length, game rules, player rotation, arena layout, equipment, or event flow when needed to keep the event safe, fair, and manageable.
17. Photos, Videos, and Media
Rc Ball may take photos or videos during events for safety, training, operational review, promotional materials, website content, social media, advertising, and business development.
Promotional use involving identifiable participants may require consent through a waiver, media release, booking form, event form, or written approval.
A parent or legal guardian must provide promotional media consent for minors.
Tell Rc Ball before the event or before participation if you do not want promotional media use.
18. Privacy
Rc Ball’s collection and use of personal information is described in our Privacy Policy.
Payments may be processed through Square or PayPal. Those providers may collect and process payment information under their own privacy policies, terms, and security practices.
19. Intellectual Property
Rc Ball names, logos, photos, videos, website content, gameplay materials, event materials, robot designs, arena designs, business materials, and brand assets are owned by Rc Ball or used with permission.
You may not copy, modify, sell, publish, reproduce, or use Rc Ball materials for commercial purposes without written permission.
20. No Guarantee of Availability
Rc Ball does not guarantee that any specific date, time, location, robot, controller, game mode, arena layout, staff member, event format, or service option will be available.
Rc Ball may adjust gameplay format, rules, timing, or equipment as needed for safety, fairness, equipment protection, staffing, or event flow.
21. Limitation of Liability
To the fullest extent allowed by law, Rc Ball is not responsible for indirect, incidental, special, punitive, or consequential damages connected to website use, booking, event delay, event interruption, event cancellation, venue conditions, participant behavior, equipment limitations, or service limitations.
Rc Ball’s total liability for a paid event will not exceed the amount paid to Rc Ball for that event, unless applicable law requires a different result.
22. Indemnification
You agree to defend, indemnify, and hold harmless Pharmers Market LLC, doing business as Rc Ball, from claims, losses, costs, damages, attorney fees, or expenses caused by your conduct, your guests, minors under your care, violation of these Terms, misuse of equipment, unsafe behavior, or claims brought by someone under your responsibility.
23. Force Majeure
Rc Ball is not responsible for delays, interruptions, cancellations, or failure to perform caused by events outside reasonable control, including severe weather, emergencies, road closures, illness, staffing emergencies, power issues, venue restrictions, equipment transport issues, government action, natural disasters, or unsafe conditions.
24. Changes to These Terms
Rc Ball may update these Terms & Conditions from time to time. The updated version will be posted on this page with a new effective date.
Continued use of our website, forms, booking process, events, or services after updates means the updated Terms apply.
25. Governing Law
These Terms & Conditions are governed by the laws of the State of New Mexico, without regard to conflict-of-law rules.
Venue for disputes will be in the appropriate courts located in New Mexico, unless applicable law requires a different location.
